2. Who is a consumer?
A consumer is an individual who purchases a service mainly for purposes outside their business, trade, profession or independent professional activity.
If you purchase a service on behalf of a company, partnership, organisation or other business activity, you are generally acting as a business customer rather than as a consumer. Business customers do not receive the statutory consumer right of withdrawal described on this page, unless mandatory law provides otherwise.
If you are unsure whether you are purchasing as a consumer or business customer, contact us at hello@casta-product.com before purchasing.
3. Services covered
Casta Product provides digital and remote product consultancy services, including:
- 90-Minute Product Decision Review
- 2-Week Product Clarity Sprint
- 4-Week Product Delivery Setup
- Fractional Product Management
- Founder MVP Launch
Casta Product does not publish hard-coded service prices. Before the consumer commits to the engagement, Casta Product will provide consumer pricing information in a written quote, including:
- the total price of the engagement; or, where a total cannot reasonably be calculated in advance, the manner in which the price is calculated, namely the applicable rate (hourly or daily) and the estimated time, as stated in the written quote;
- confirmation that the price in the accepted quote is the price for the agreed scope;
- that any work beyond the agreed scope, or any additional time, is charged at the rate stated in the quote and only after the consumer agrees to it in advance, and the consumer is never charged for additional work they did not agree to;
- VAT status: Stensmann Group s.r.o. is not a VAT payer, so no VAT is added; and
- no shipping, delivery, return or other incidental costs apply, because the services are provided remotely.
Unless the applicable statement of work clearly states otherwise:
- no fee is charged for exercising the right of withdrawal.
For these purposes, “incidental costs” means additional costs that might otherwise arise in connection with a purchase, such as delivery, shipping, handling or mandatory charges. Casta Product does not charge such costs for its digital and remote services.
4. Right of withdrawal
If you are a consumer and purchase a Casta Product service through the website or another distance-selling method, you have the right to withdraw from the contract without giving a reason.
The withdrawal period is 14 days and begins on the day the contract is concluded. For a paid service, the contract is generally concluded when your purchase is accepted and payment is successfully processed.
You may withdraw at any time during the 14-day period by sending us a clear statement that you wish to withdraw. You may use the model withdrawal form included below, but you do not have to use that form.
To meet the deadline, it is sufficient to send your withdrawal notice before the 14-day period expires. We recommend keeping evidence that the notice was sent.
5. How to withdraw
Send your withdrawal notice by email to: hello@casta-product.com
Your notice should include enough information to identify:
- your name;
- your email address;
- the service purchased;
- the date of purchase or contract conclusion;
- your order, payment or invoice reference, if available; and
- a clear statement that you are withdrawing from the contract.
You do not need to provide a reason.
You may use the model withdrawal form in section 11, or you may write your own clear statement. A statement such as the following is sufficient:
We will acknowledge receipt of your withdrawal notice by email without undue delay.
6. Effect of withdrawal and refunds
If you withdraw validly from the contract:
- we will refund all payments received from you;
- the refund will be made within 14 days after we receive your withdrawal notice;
- the refund will normally be made using the same payment method used for the original transaction; and
- you will not be charged a refund or administration fee.
If you paid by card or another payment method through Stripe, the refund will normally be processed through Stripe to the original payment method. We may delay the refund only where permitted by applicable law. Because Casta Product provides digital and remote services, there is normally no physical item to return and no return or shipping cost for you to pay.
7. Starting work during the 14-day period
You may ask Casta Product to begin providing the service before the 14-day withdrawal period has ended. To do this, you must:
- make an express request for the service to begin before the 14-day period expires; and
- acknowledge that, once the service has been fully performed, you will lose the right to withdraw.
This request and acknowledgement must be recorded in a durable form, such as an electronic checkout record or email confirmation.
If you withdraw after work has started
If you expressly asked us to start work before the 14-day period ended and then withdraw before the service is fully performed, you must pay an amount proportionate to the part of the service actually provided up to the time you notify us of your withdrawal.
The proportionate amount will be calculated by reference to:
- the total agreed price; and
- the part of the service already performed when the withdrawal notice was received.
Any remaining balance will be refunded.
If the service has been fully performed
If you expressly asked us to begin the service before the 14-day withdrawal period ended, and you acknowledged that you would lose the right of withdrawal once the service was fully performed, you will lose the right of withdrawal once the service has been fully performed.
If work started without the required consent
If Casta Product began providing the service without your express request to start early and without your acknowledgement of the consequences, you retain your right of withdrawal. In that situation, if you withdraw during the 14-day period, you will not be required to pay for the work performed before withdrawal.
8. Checkout consent wording
Where a consumer wants Casta Product to begin work immediately, the checkout or pre-payment confirmation should include a separate, unticked checkbox with wording substantially similar to the following:
“I expressly request Casta Product to begin providing the service immediately, before the 14-day withdrawal period has ended. I understand that I may have to pay for the proportion of the service performed before I withdraw and that I will lose my right of withdrawal once the service has been fully performed.”
The checkbox should not be pre-selected. The consumer should actively select it before payment or before work begins. Casta Product should retain evidence of: the wording shown to the consumer; the date and time of consent; the consumer’s identity or order reference; the service concerned; and the consumer’s affirmative selection of the checkbox.
Alternative wording for business buyers
A business buyer may be shown a separate confirmation such as:
“I confirm that I am purchasing this service for business, trade, professional or organisational purposes and not as a consumer. I understand that statutory consumer withdrawal rights do not apply to this purchase, subject to mandatory law.”
This business confirmation should not replace the consumer checkbox for an individual who is purchasing outside their business or professional activity. The checkout process should allow the buyer to identify whether they are purchasing as a consumer or business customer. If the buyer’s status is unclear, Casta Product should treat the buyer as a consumer until the position is clarified.
9. Confirmation on a durable medium
After purchase, Casta Product will provide the consumer with confirmation of the contract and the applicable pre-contract information on a durable medium. This may include an email containing, or linking to a downloadable copy of:
- the service purchased;
- the agreed price;
- the applicable terms;
- this withdrawal information;
- the model withdrawal form;
- any early-performance consent and acknowledgement;
- the order or payment reference; and
- the contact details for exercising withdrawal rights.
A “durable medium” means a format that allows the consumer to store the information and reproduce it unchanged for an appropriate period, such as email or a downloadable PDF. Casta Product should retain a copy of the confirmation and any consent record in its business records.
10. Complaints and out-of-court dispute resolution
If you have a complaint, please contact us first at: hello@casta-product.com.
Please describe the issue and state the outcome you are seeking. We will try to resolve the matter directly. If you are not satisfied with our response, you may seek out-of-court dispute resolution through the Czech Trade Inspection Authority:
- Authority:
- Česká obchodnà inspekce (ČOI)
- Address:
- Štěpánská 44, 110 00 Prague 1, Czech Republic
- Website:
- https://coi.gov.cz/en/
- ADR Information:
- https://coi.gov.cz/en/information-about-adr/
The ADR process is intended to help consumers and traders reach an amicable solution. It does not generally replace a court claim and may not produce a binding decision.
